§ 1 Scope

These Terms and Conditions apply to all orders placed through the online shop at www.gourmiegoods.com.

The offer is directed at both consumers and businesses. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. A business is any natural or legal person or partnership acting in the exercise of their commercial or independent professional activity.

Any terms and conditions of the customer that deviate from these Terms and Conditions shall not apply unless expressly agreed to in writing.

§ 3 Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer but rather an invitation to place an order.

By clicking the "Buy Now" button or a comparable order button, the customer submits a binding offer to purchase the goods contained in the shopping cart.

After receipt of the order, the customer will receive an automatic order confirmation by email. This order confirmation does not constitute acceptance of the offer.

The purchase contract is concluded once we accept the order by means of an order confirmation email or dispatch the goods.

§ 4 Prices and Payment

All prices are stated in Euro and include applicable VAT where required by law.

Any additional shipping costs will be displayed separately during the checkout process.

The available payment methods are displayed during checkout.

§ 5 Delivery

Delivery will be made to the delivery address specified by the customer.

Any delivery times stated are estimates unless expressly agreed otherwise.

Should a product become temporarily unavailable, we will inform the customer without undue delay.

Partial deliveries may be made where reasonable for the customer.

§ 5a Product Information

Food products are described and presented with the greatest possible care. Due to natural variations in artisan-produced goods, colour, shape, weight, or packaging may differ slightly from product images and descriptions without constituting a defect.

§ 6 Right of Withdrawal

Consumers are entitled to the statutory right of withdrawal.

§ 7 Retention of Title

The goods remain our property until full payment has been received.

§ 8 Statutory Warranty Rights

The statutory warranty rights under applicable law shall apply.

§ 9 Liability

We shall be liable without limitation for intent and gross negligence.

In cases of ordinary negligence, we shall only be liable for breaches of essential contractual obligations, the fulfilment of which is necessary for the proper performance of the contract and on which the customer may regularly rely. In such cases, liability shall be limited to the foreseeable damage typical for the contract.

The above limitations of liability shall not apply in cases of injury to life, body, or health, or in cases of liability under applicable product liability laws.

§ 10 Online Dispute Resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

§ 11 Governing Law

These Terms and Conditions shall be governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

For consumers, this choice of law shall apply only to the extent that it does not deprive them of the protection granted by mandatory provisions of the law of the country in which they have their habitual residence.
